NLRB Delays Deadline for New Posting Again

In September, we reported on the National Labor Relations Board's (NLRB) new regulation requiring most private employers to post a notice of employees' rights under the National Labor Relations Act (to organize and join a union, among other rights). Initially scheduled to take effect November 14, 2011, the NLRB extended the posting deadline once, until January 31, 2012. The NLRB has now agreed to extend the effective date of the posting again--to April 30, 2012.

Business groups, including the National Association of Manufacturers (NAM) and the US Chamber of Commerce, oppose the new rule, alleging the posting is another attempt by the Board to promote unionization. NAM and the Chamber have filed lawsuits to stop the posting, alleging the Board exceeded its statutory authority in mandating the posting. The Board claims the latest extension will facilitate resolution of the legal challenges that have been filed against the rule.
